Agreement to these terms

By using mycarsnotjunk.com (the "Site"), you agree to these Terms. If you do not agree, do not use the Site. They apply to everyone who visits, signs in, posts a listing or sends a message. Our Privacy Policy explains what we do with your information and is part of these Terms.

Who we are

MyCarsNotJunk is operated by Big Ugly Truck LLC ("we", "us", "our"). The Site is a place where people list vehicles for sale and buyers contact sellers. Listing is free.

We are not a party to any sale between users. We do not own, inspect, value, hold or deliver the vehicles listed, we do not handle payment, and we do not act as anyone's agent or broker. Separately, we sometimes buy certain vehicles directly; any such purchase is its own agreement, made in writing, and nothing on the Site obliges us to buy anything.

Your account and your phone number

You sign in with a mobile phone number, which we verify by sending a one-time code by text message. You must be at least 18 years old and able to enter a binding contract to create an account. Use your own number, keep it current, and do not let anyone else use your account; you are responsible for what is done with it.

The name you give is shown to buyers and sellers you deal with. Your phone number is not shown to anyone on the Site. If you lose access to your number, you lose access to the account that uses it until you contact us.

Listings and photos

You may list a vehicle you own or are authorized to sell. Everything in a listing must be true to the best of your knowledge, including the year, make, model, mileage, title status and condition, and the photos must be of that vehicle. You may not list a vehicle you know or suspect is stolen, a vehicle you do not have the right to sell, or the same vehicle more than once.

Do not put a phone number, email address or other contact details in a listing's text or photos. Buyers contact sellers through the Site's messages. This protects both sides from scams and from having a number scraped off a public page, and a listing that includes contact details may be removed.

You keep ownership of what you post. By posting it, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, crop, display and distribute it on the Site and in links to the Site (for example in search results or when someone shares a listing), for as long as the listing is up and for a reasonable time afterwards. You confirm you have the right to grant that licence, including for every photo.

When you upload a photo, we resize it and remove its embedded data, including any location data, before storing it. Listings stop showing after a set period unless you renew them, and you can edit, mark as sold, hide or delete your own listings at any time from My listings.

Messages between users

Messages you send and receive on the Site are stored on the Site so that both people in a conversation can read them. When someone sends you a message, we send you a text message with a link to it; the text does not include what the message says.

Use messages to discuss the vehicle and the sale. Do not use them to harass anyone, to send spam or advertising, to ask for payment outside a genuine sale, to send links designed to collect someone's information, or to break the law. Either person can block a conversation, which stops both sides from sending further messages, and either can report it to us.

Messages are private between the two people in the conversation. We do not read them routinely, but we may review a conversation when it is reported, when we suspect fraud or abuse, or when the law requires it.

Buying and selling

Any sale is between the buyer and the seller. You are responsible for checking the vehicle, the title and the other person before any money changes hands. We recommend meeting in a public place, seeing the vehicle and its title in person, checking the VIN against the title, and never sending a deposit or payment for a vehicle you have not seen. We do not guarantee any listing, any user, or that a sale will happen.

Removal, suspension and bans

We may hide or remove any listing, block any conversation, and suspend or ban any account or phone number, at any time and for any reason, including a report from another user, a listing or message that breaks these Terms, or conduct we believe puts other users at risk. A banned number cannot sign in. We are not obliged to monitor the Site, to explain a decision, or to keep content we have removed.

You can stop using the Site at any time. To have your account removed, contact us using the details below.

Text messages

By entering your phone number and requesting a code, you agree to receive text messages from MyCarsNotJunk at that number: one-time sign-in codes, and a notification with a link when someone sends you a message on the Site. We do not send marketing texts. How often you get texts depends on how often you sign in and how many messages you receive. Message and data rates may apply.

Reply STOP to any of our texts to stop receiving them, and HELP for help. If you stop texts, you will not be able to sign in with a code or be told about new messages until you start them again. Mobile carriers are not liable for delayed or undelivered messages.

Vehicle information

When you enter a VIN, we look it up with outside sources, including the National Highway Traffic Safety Administration, to suggest the year, make, model and other details. That information is provided as is and may be incomplete or wrong; the seller is responsible for what the listing says. A VIN that decodes as a commercial vehicle cannot be listed here.

Intellectual property

Apart from what users post, the content of the Site, including its text, design, logos and code, belongs to Big Ugly Truck LLC or its licensors and is protected by copyright and other laws. You may not copy, scrape, reproduce or redistribute it, or collect listings or users' information from the Site by automated means, without our written permission.

Vehicle make and model names belong to their manufacturers. We are not affiliated with, endorsed by or sponsored by any manufacturer named on the Site.

Third-party links and services

The Site links to and relies on other companies' services, and may link to other websites. We are not responsible for their content, their practices or their terms, and a link is not an endorsement.

Disclaimer of warranties

The Site and everything on it are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, secure or free of errors, that any listing or user is genuine, or that any vehicle is as described.

Limitation of liability

To the fullest extent the law allows, Big Ugly Truck LLC and its owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, money or vehicles, arising from your use of the Site or from any dealings between users, even if we were told such damages were possible.

Our total liability to you for any claim arising from these Terms or the Site is limited to one hundred dollars ($100).

Indemnification

You agree to indemnify, defend and hold harmless Big Ugly Truck LLC and its owners, employees and agents from any claim, loss, liability or expense, including reasonable attorneys' fees, arising from your listings, your messages, your dealings with other users, your breach of these Terms, or your violation of any law or anyone's rights.

Governing law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be resolved only in the state or federal courts located in DeKalb County, Georgia, and you consent to those courts' jurisdiction.

Changes to these terms

We may change these Terms at any time. When we do, we update the date at the top of this page. Continuing to use the Site after a change means you accept the changed Terms.

Entire agreement

These Terms and the Privacy Policy are the entire agreement between you and Big Ugly Truck LLC about the Site and replace any earlier understanding. If any part of them is found unenforceable, the rest stays in effect. If we do not enforce a part of them, we have not given up the right to.
